TERMS & CONDITIONS

These Terms & Conditions apply to all purchases from Stone & Design Market USA LLC, whether by individual homeowners or trade professionals like contractors, designers, or resellers. Notes have been added where relevant for each party.

CLAIMS

No claims can be made after installation. Please inspect all products upon delivery and prior to installation. Installing the material constitutes acceptance.

INSTALLATION

• For white marble, limestone, and cement-based products, use moisture-sensitive thin-set to avoid staining or color bleeding. Always use clean water and premium white thin-set.
• All customers: Open and inspect all boxes before installation. Dry-lay the material to check consistency in shade and texture.
• Contractors: Blend materials from multiple crates to ensure a uniform appearance for your client.
• Homeowners: We highly recommend reviewing and approving the layout before installation begins.
• Order extra material to account for cuts, waste, and selection. We suggest at least 10% extra for standard cuts and up to 30% for diagonal or complex patterns.
• Natural stone varies in color, veining, and texture; these variations are part of its natural beauty and not defects.
• If ordering additional material later, exact shade matching with your original order cannot be guaranteed.
• Use grout release or sealer before grouting.
• A minimum 1/8″ joint is recommended to accommodate expansion and contraction.
• Minor imperfections, such as pits or fill, are inherent in natural stone and are not considered flaws.

NO WARRANTY OF COLOR

Products are natural and handmade, so shade variation is expected and enhances uniqueness. Stone & Design Market USA LLC is not responsible for color differences between shipped tiles and showroom samples.

ACCEPTANCE

Any questions regarding color, design, or quality must be raised before installation. Installing the product indicates acceptance. Claims or returns after installation will not be accepted. Issues must be reported within 30 days of delivery.

NO WARRANTY AS TO QUANTITY ESTIMATES

Quantity estimates are not guaranteed. Buyers are responsible for verifying square footage and ordering accordingly.

AVAILABILITY

All items are subject to availability at the time of shipping. If an item is unavailable, we will notify you and may propose an alternative.

TERMS: PAYMENT

• Prices are subject to change without notice.
• All totals are subject to final confirmation. Any adjustments will be communicated before finalizing your order.

EXCLUSION OF DAMAGES

We are not liable for indirect, incidental, or consequential damages. No warranties are provided beyond standard product use.

NORMAL WEAR & GROUT

Tiles may show wear, crazing, or light scratches over time. Choose grout color carefully and use grout release to prevent staining.

SPECIAL OR CUSTOM ORDERS

• Special orders require a 50% deposit when placing the order.
• Remaining balance is due before shipping once the order is ready.
• Special or custom orders are non-cancelable and non-returnable.

DELIVERY TERMS

• All deliveries are F.O.B. from our warehouse.
• We are not responsible for transit damage. Inspect your shipment immediately upon receipt.
• Damage claims must be submitted to the carrier in writing within 5 days, with a copy sent to us.
• Contractors/resellers: Responsible for unloading and safe storage at the site or warehouse.
• Homeowners: Arrange assistance for unloading, as delivery drivers typically do not carry materials inside.

SAMPLE SHIPMENTS

Sample charges apply per item. Orders exceeding 2 samples of the same product may incur additional packaging fees. We are not responsible for breakage during shipping.

FORCE MAJEURE

Stone & Design Market USA LLC is not responsible for delays or cancellations due to events beyond our control (e.g., natural disasters, transportation issues). Delivery timelines may be adjusted accordingly.

ASSIGNMENT

This agreement cannot be transferred by the customer without written approval.

CONFLICT OF TERMS

In case of conflicting documents, the terms in this agreement take precedence. Any changes must be in writing and signed by both parties.
